ClaimStrike DMCA Automation Agreement
This is a public, read-only version of the ClaimStrike Terms of Service. You will be asked to formally accept these terms during onboarding.
1. Scope of Services
- ClaimStrike automates piracy scans and the submission of DMCA takedown notices on your behalf.
- The service is subscription-based and automates recurring piracy scans and DMCA takedown submissions.
2. Ownership Confirmation
- You confirm you own or are licensed to protect all monitored content.
- You confirm no content monitored infringes third-party rights.
3. Authorization for DMCA Enforcement
- You authorize ClaimStrike to submit DMCA takedown notices including your legal name, email, and address.
- Your information is used solely for DMCA compliance under 17 U.S. Code § 512.
4. User Responsibilities
- During onboarding, you will review a sample of DMCA notices, verify your personal information (name, address, email), and confirm that the identified links pertain to your own content.
- You accept full responsibility for your content configuration accuracy.
- You must refresh Gmail authorization promptly if requested to ensure uninterrupted DMCA processing.
- You are responsible for monitoring your Gmail account and responding to third-party hosts if needed.
- You may be asked to complete a one-time ownership verification with certain third-party hosts during your first DMCA submissions.
- ClaimStrike may temporarily cap DMCA frequency ("Pilot Phase") for new accounts with heavy piracy backlogs.
5. DMCA Follow-Up Policy
- ClaimStrike automatically monitors the status of submitted DMCA notices.
- If no action is taken by the recipient, ClaimStrike applies a per-link 48-hour cooldown before initiating follow-up actions.
- This helps reduce the risk of spam flagging by third-parties.
6. Liability and Indemnification
- You agree to indemnify ClaimStrike from any claims or disputes arising from your use of the service.
- You understand submitting fraudulent DMCA notices is illegal under 17 U.S. Code § 512(f).
7. Termination and Cancellation
- You may cancel your subscription at any time.
- ClaimStrike may suspend accounts involved in abuse or fraudulent activity.
8. Legal Jurisdiction
- This agreement is governed by the laws of Quebec, Canada.
9. ClaimStrike's Commitment
- Relentlessly crack down on the vile practice of piracy on your behalf.
- Stay ahead of emerging piracy practices to the best of our abilities.
- Continuously upgrade ClaimStrike’s automation capabilities to adapt to new threats.
- Expand scanning coverage as new piracy sites emerge.
- Provide transparent, timely reporting to end-users through weekly email summaries.
